These Terms & Conditions (“Terms”) govern your access to and use of https://www.ohanacohost.com/ (the “Site”). The Site is owned and operated by Ohana Cohost, a Wyoming limited liability company (“Ohana Cohost,” “we,” “us,” or “our”). By using the Site, you agree to these Terms.

1) The Site and Our Services

The Site provides general information about our short-term rental co-hosting and consulting services and allows you to submit inquiries, including requests for a free revenue snapshot.

Any paid services we provide are governed by a separate written agreement. If there is a conflict between these Terms and a signed client agreement, the signed client agreement controls.

2) Free Revenue Snapshot (No Guarantees)

If you request a free revenue snapshot, you understand and agree:

  • It is a high-level estimate for informational purposes only, based on limited information you provide and general market data/assumptions.

  • Actual results vary and depend on many factors outside our control (including pricing, seasonality, guest behavior, reviews, competition, platform policies, local ordinances, HOA rules, taxes, and property condition).

  • Any information provided is for general informational purposes and is not legal, tax, or financial advice.

  • We do not guarantee revenue, occupancy, rankings, or any performance outcome.

3) Communications

By submitting a form on the Site, you are requesting that we contact you about your inquiry. We may contact you by email and/or phone to respond.

If you separately opt in to marketing emails or text messages, you can opt out at any time using the instructions provided (for example, unsubscribe links for emails or replying STOP for texts).

4) Acceptable Use

You agree not to:

  • access or attempt to access the Site through automated means (scraping, bots, data mining) without our written permission;

  • interfere with the security or operation of the Site;

  • attempt to gain unauthorized access to systems or data;

  • use the Site for unlawful, abusive, defamatory, or fraudulent purposes.

We may suspend or terminate access to the Site at any time if we believe you have violated these Terms.

5) Intellectual Property

All content on the Site, including text, graphics, logos, images, and page design, is owned by Ohana Cohost or its licensors and is protected by intellectual property laws. You may not copy, reproduce, distribute, or create derivative works from Site content without our written permission.

6) Third-Party Tools and Links

The Site may include third-party tools or links (for example, embedded services, analytics, or advertising technology). We are not responsible for third-party websites or services and your use of them is subject to their terms and policies.

7) Disclaimers

THE SITE AND ALL INFORMATION PROVIDED THROUGH IT ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

8) Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OHANA COHOST WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF (OR INABILITY TO USE) THE SITE OR ANY FREE REVENUE SNAPSHOT.

IF WE ARE FOUND LIABLE FOR ANY CLAIM RELATED TO THE SITE OR A FREE REVENUE SNAPSHOT, OUR TOTAL LIABILITY WILL NOT EXCEED $100 OR THE AMOUNT YOU PAID US FOR THE APPLICABLE SERVICE, WHICHEVER IS GREATER.

9) Indemnification

You agree to indemnify and hold harmless Ohana Cohost and its owners, officers, employees, and agents from any claims, liabilities, damages, and expenses (including reasonable attorneys’ fees) arising out of your misuse of the Site or violation of these Terms.

10) Changes to These Terms

We may update these Terms from time to time by posting the updated version on the Site. Your continued use of the Site after changes become effective means you accept the updated Terms.

Assignment: We may assign these Terms in connection with a merger, acquisition, reorganization, or sale of assets. You may not assign these Terms without our prior written consent.

Severability: If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions will remain in full force and effect.

11) Governing Law and Venue

These Terms are governed by the laws of the State of Wyoming, without regard to conflict-of-law rules.

Any dispute arising out of or relating to these Terms or the Site must be brought exclusively in the state or federal courts located in Laramie County, Wyoming (Cheyenne), and you consent to personal jurisdiction and venue in those courts.
